This is the webshop of NauticForSale.com, trade name of JVS Shipping B.V. We sell marine electronics, new and refurbished, to skippers all over the world. To deliver an order we need a few details from you. Below is exactly which ones, why we use them, how long we keep them and what you can say about them.

We keep it short wherever we can. We do not sell your data to anyone and we do not link your visit to your name or your order. We track how many people visit the shop, and we measure whether our own adverts deliver anything, but only if you have said yes to that; in our cookie policy you can switch that on and off.

If you have a question about your data, one email is enough. You do not need to fill in a form for that.

Which data we use, and what for

Placing an order

We ask for your name, address, email address and phone number, and for a business order also the company name and VAT number. We also keep what you ordered, what you paid and where it was sent.

The shop also records the IP address an order was placed with. We do not do this to track you, but because it is the only lead we have in case of a disputed or fraudulent order. It is stored only with the order itself and follows the same retention period.

Why: without this data we cannot deliver the order or issue the invoice. Legal basis: performance of the sales contract (Article 6(1)(b) GDPR), and for the invoice our legal obligation (sub c). How long: invoices and everything that belongs with them for seven years, because the Dutch Tax Authority requires this of us. We delete the rest no later than two years after the last order.

Creating an account

An account is not required; you can also check out as a guest. If you do create one, we keep your email address, your password in encrypted form, your address details and your order history, so you do not have to fill those in every time.

Legal basis: the contract and your own request. How long: for as long as you keep the account. If you close it, we delete it, except for the invoice details we must keep for seven years.

Paying

Payment runs through Mollie B.V. in Amsterdam. You enter your payment details with Mollie, not with us: we never see your full account number or card number. Mollie only tells us whether the payment succeeded, with which method and under which reference.

Send

For shipping we pass on your name, address, email address and phone number to Sendcloud B.V. and to the carrier driving or flying the parcel. Your phone number and email address go along so the carrier can reach you about the delivery.

If a shipment goes outside the European Union, we are required to also send customs data: what is in the box, what it is worth, the commodity code and sometimes your VAT or EORI number. That is not our choice but the destination country's customs requirement.

Requesting a price, placing a search request or contacting us

For a price request, a search request or an ordinary question we keep your name, email address, your phone number if given, and what you write to us. We use this only to answer you and to be able to find your request again if you come back to it later.

Legal basis: steps taken at your request before a contract exists (sub b), and our legitimate interest in being able to find our own correspondence again (sub f). How long: twenty-four months after the request has been handled.

The newsletter

Only if you sign up for it yourself do we keep your email address, to send you word about new stock. Legal basis: your consent. How long: until you unsubscribe. You can unsubscribe with the link under every newsletter or with one email to us; we then remove you straight away.

Calculating shipping cost

On every product page you can enter the country it needs to go to. We use that country only to work out the rate on the spot. We do not store it and do not link it to you.

The language of the shop

The shop tries to greet you in your own language. As long as you have not allowed translation, we only look at the language setting your browser sends along for that. That setting never leaves our server.

If you give permission for translation, we look up with the company ip-api.com which country your IP address belongs to, so we can choose the right language. We keep the result for twelve hours, so it does not have to be looked up again on every page. More about this is in our cookie policy.

Server log files

Our server records the IP address, the time, the page requested and the type of browser for every visit. We need this to be able to spot faults and attacks. Legal basis: our legitimate interest in a working and secure shop (sub f). How long: fourteen days, after which they are automatically deleted.

Cookies

Which cookies we place and what for is listed separately and in detail in our cookie policy. There you can also change or withdraw your choice at any time.

Who else gets to see your data

We engage a number of companies to keep the shop running. With the parties that work for us we have data processing agreements, which state that they use your data only for our assignment.

  • Hetzner Online GmbH (Germany): the server the shop runs on.
  • Mollie B.V. (Netherlands): the payments.
  • Sendcloud B.V. (Netherlands) and the carriers: shipping and tracking the parcel.
  • Our accountant: the invoices, for the bookkeeping and the tax return.
  • Google Ireland Ltd. / Google LLC: the translation, the visitor counter and measuring our adverts, each only if you have allowed it.
  • ip-api.com: only if you have allowed translation, to look up the country for your IP address.

Beyond this we do not pass anything on, unless a law or a court requires us to. We do not sell your data and do not rent it out.

Data outside Europe

Two kinds of data leave the European Union.

The first is what goes to Google: the translation engine, the visitor counter and measuring our adverts. All three only run if you give permission for that, and without that permission nothing is retrieved from Google. Google LLC in the United States is part of the EU-US Data Privacy Framework, the agreement with which the European Commission approved transfers to participating US companies; the European Commission's standard contractual clauses also apply.

The second is your parcel. If you order from outside the EU, your address and customs data go to the destination country, because delivery could not otherwise take place. This is permitted under Article 49(1)(b) GDPR: the transfer is necessary to perform our contract with you.

How we secure your data

All traffic with the shop is encrypted over https. We store passwords encrypted and they are not readable even to us. Only staff who need it can access order data, with their own account. The server is updated as soon as security updates are available and backups are made daily.

If something still goes wrong despite all this and you are put at risk as a result, we will let you know and report it to the Dutch Data Protection Authority, as the law requires.

What you can ask

You have the following say over your own data:

  • Access: you may request which data we hold about you.
  • Rectification: if something is wrong, we correct it.
  • Erasure: you may ask us to delete your data. What we must keep for tax purposes we cannot throw away; we do lock that down, though.
  • Restriction: you may ask us to temporarily suspend use, for example while a complaint is being handled.
  • Objection: against use that rests on our legitimate interest.
  • Portability: you can receive your data in a common file format.
  • Withdrawing consent: for the newsletter and for the cookies you said yes to. This is always possible, and it applies from that moment on.

One email to us is enough. We respond within a month. To avoid handing data to the wrong person, we may ask you to identify yourself; for an order, a question about the order itself is usually already enough. We do not charge anything for this.

If you disagree with how we handle your data, tell us first, that is usually the fastest route. You also always have the right to file a complaint with the Dutch supervisory authority, the Autoriteit Persoonsgegevens.

No automated decisions

We do not make decisions about you using computers alone, and we do not profile visitors. Prices are the same for everyone; what you have looked at before does not change that.

Children

Our shop is intended for commercial shipping and watersports and is not aimed at children. We do not knowingly collect data from children under sixteen. If you think this has happened anyway, let us know, and we will remove it.

Changes

If something about the shop changes so that this policy no longer matches it, we update it and put the new date below it. If it concerns something material, for example a new party that gets to see your data, we ask for your consent again.
